STANDARD TERMS OF SALE

ARTICLE N°1 – SCOPE OF APPLICATION

These standard terms of sale apply to the contract entered into between Camille Fournet, a public limited liability company [société anonyme], registered at the Paris (France) Company Register, under No. 302 475 611, whose registered office resides at 9, place de la Madeleine, 75008 Paris (hereinafter referred to as “Camille Fournet”) and the consumer, the client of the online boutique www.camillefournet.com (hereinafter referred to as the "Client").
For these purposes, "consumer" shall imply any natural person acting for the satisfaction of her/his personal needs, to the exclusion of any professional needs.

ARTICLE N°2 – PURPOSE

The purpose of these standard terms is to define the contractual conditions applicable to the sale of the Camille Fournet leather products and watch straps from the online boutique accessible at www.camillefournet.com.
These standard terms are supplemented by the order form, completed online by the Client, all of which together form the sales contract entered into between the parties.

ARTICLE N°3 – GEOGRAPHICAL SCOPE

Camille Fournet watch straps can be ordered for delivery to all countries, provided that :

  1. The Client’s address is served by Camille Fournet’s express carrier
  2. The client’s address is not situated in China or Japan
  3. The material of the product ordered is not subject to CITES regulations. In the event that it is, in order to comply with the enforced CITES regulations, the house of Camille Fournet ensures all necessary administrative procedures be completed (requests for certificates, procedures for customs, etc.).

The list of authorized destinations is as follows:

  • European Union (Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Northern Ireland, Italia, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech republic, Romania, United Kingdom, Slovakia, Slovenia, Sweden)
  • Switzerland
  • United States
  • Hong Kong
  • Other: Monaco, Saint-Martin, Jersey, Guernsey, Gibraltar, Guadeloupe, Martinique, New Guinea, Reunion Island, Lichtenstein

Consequently, all orders that do not meet the aforementioned conditions will not be completed.

ARTICLE N°4 – CHARACTERISTIC OF THE PRODUCTS OFFERED

The products offered (hereinafter the "Product(s)") are those appearing in the catalogue published on the pages of the online boutique www.camillefournet.com.
Each product is accompanied by a detailed description prepared by Camille Fournet. Although the catalogue’s photographs are as accurate as possible, Camille Fournet cannot guarantee the accuracy and precision of the material presented. Consequently, the color of the requested watch strap may marginally vary.
Some systems for attaching watch straps to the watch case involve inserts (metal or plastic components incorporated into the strap). These are not available from our online boutique.
For all made-to-measure leather strap orders submitted using the configurator, customers have a 48-hour period during which they may modify their order. Once 48 hours have passed, modifications can no longer be made.
The inquiry of your watch brand and model is requested for reference only and does not guarantee that the purchased strap will correspond to the dimensions of your watch case or wrist. As these dimensions are measured and provided by the customer during his/her order, they remain the customer’s responsibility.
Any clarifications can be requested in writing or by telephone from the Customer Service department, the contact information of which is indicated in the "Customer Service" article below.

ARTICLE N°5 – ORDER

A Buyer wishing to place an order for a Product must:

  • Complete the online order form, selecting each of the references detailing the Products chosen, in accordance with the process indicated. The Client is entitled to change her/his mind at any time in order to modify her/his selection;
  • Provide her/his client number, or complete the identification information and the desired delivery address;
  • Confirm her/his order, upon having reviewed it;
  • Provide payment in the conditions stipulated in the "Payment" article below.
  • Confirmation of the order expresses the Client’s acceptance of the Camille Fournet offer appearing on the order form, as well as the Client’s acceptance of these general terms of sale.

Camille Fournet will acknowledge receipt of the order by sending an e-mail to the Client’s address.
Camille Fournet reserves the right not to accept an order if it believes that the Client is not acting as a consumer or may be insolvent, or if Camille Fournet suspects fraud.
All orders placed on www.camillefournet.com will be archived for a minimum time period of 10 years.

ARTICLE N°6 – PRICING POLICY

The prices appearing in the online catalogue are expressed in euros or in US dollars. Prices are understood to include all taxes on the date of the order.
The price of the Products does not include delivery expenses, which are invoiced separately, for a fixed amount indicated on the pages of the online boutique www.camillefournet.com, as well as on the order summary.
Any customs duties and taxes other than value-added tax are also invoiced separately from the selling price and charged to customers.

ARTICLE N°7 – PAYMENT

Products are required to be paid in full at the time of the order.
Payments must be made by credit card or via Paypal; payments will be made using the online payment platform of Camille Fournet’s bank or Paypal, to which the client will be automatically directed.
The Client is informed that Camille Fournet requires the use of the 3D Secure or Verified by Visa security mechanisms, depending on the Client’s card. The Client must ask her/his bank for access to these services.
The buyer’s account will be debited on the date of the order.
A hardcopy invoice, indicating the invoice’s payment, will be sent to the Client with the package containing the Product.

ARTICLE N°8 – RESERVATION OF TITLE

The Products shall remain property of Camille Fournet, until they have been paid in full.

ARTICLE N°9 – SHIPPING AND DELIVERY

The Products are delivered by an express delivery carrier, to the address indicated on the order form. The Client may request that the Product be delivered to a third party, to the latter's address. Camille Fournet does not accept orders having as a delivery address a “poste restante” [general delivery], or a post office box.
Camille Fournet will inform the Client once the Product has been dispatched, and will indicate if a package tracking mechanism is provided on the carrier's website. In the event of a simultaneous order for a watch strap and another leather Product, the watch strap(s) may be delivered in separate packages.
The deadline by which Camille Fournet commits to deliver the Product will be sent by email to the buyer. Camille Fournet shall immediately inform the Client if it is aware that it is possible that the Products will not be delivered by the announced delivery date.
If the indicated delivery deadline is surpassed by more than seven days, the Client shall be entitled to ask Camille Fournet to cancel the sale. This request must be made by registered mail with return receipt. The Client shall be reimbursed in the same conditions as those stated in the cancellation stipulated in the article below.
The cancellation stipulated in this article is only applicable to Clients whose primary residence is in the European Union.
In the event of damages during transport, a reasoned complaint must be made to the carrier within three days of the delivery.
If the Product ordered is unavailable, Camille Fournet shall inform the Client by e-mail. The Client will then be reimbursed without delay and, at the latest, within thirty days from the payment of the amounts that s(he) has paid. Thereafter, these amounts shall accrue interest at the official rate.

* : Precious leather goods are subject to CITES regulations. Camille Fournet takes care of all necessary administrative tasks to follow your items (request for certificates, customs clearance ...), results a longer delivery time.

ARTICLE N°10 – RETURNS AND EXCHANGES

For all products purchased on www.camillefournet.com, in the event that a shipment is either not conform to the ordered product or defective, customers have fourteen (14) calendar days following the shipment date to exchange it for an alternate item or be reimbursed.
Returned products must be:

  • In their original state (new, never worn)
  • In their original packaging
  • Accompanied by the original invoice or a copy of the invoice
  • Accompanied by an explanation for the return

Made-to-measure items that have been personalized by the customer with one or more technical options or dimension specifications cannot be returned or exchanged.

Reimbursement for your order will be made within 14 days following our teams’ reception of the returned product.

ARTICLE N°11 – RIGHT OF WITHDRAWAL

The benefits of this article solely apply to Clients whose primary residence is in the European Union.
The Client shall have a period of seven days following delivery to cancel her/his order, without having to indicate the reason, and without having to pay a penalty, with the exception of return expenses. The Client can also exercise her/his right to cancel before her/his order is dispatched.
In this event, the Client will be responsible for returning the product to the Camille Fournet address indicated in the "Customer Service" article below.
Returned products must be:

  • In their original state (new, never worn)
  • In their original packaging
  • Accompanied by the original invoice or a copy of the invoice

If the Product is to be delivered to a third-party, the latter can only request an exchange. No reimbursement can be made to a third-party recipient in the event of a difference of price. The Client maintains her/his right to cancel, regardless of the circumstances.
In compliance with the article L.121-21-4 of the consumption code, the products and shipping fees will be refunded to the customer within 14 days of the request date, through the same payment method initally used by the consumer. Thereafter, the amount due shall accrue interest at the official rate in effect. Reimbursements are made by crediting the credit card with which the Client paid for the Product.
The right to cancel stipulated in this article does not apply to watch straps that the Client personalizes by selecting one or more technical or size options offered at the time of her/his order.

The shipping costs will be charged to customers.

ARTICLE N°12 – WARRANTIES

The Products are covered by the legal warranty of conformity provided for by Articles L.217-4 to L.217-14 of the French Consumer Code [le code de la consommation]. This warranty must be mentioned by the Client within two years from delivery.
Any watch strap delivered, the size of which varies by more than two-tenths of a millimeter in terms of the width of the box and by more than two millimeters with regards to the length of the box, compared to the dimensions of the Client’s order, shall be deemed to conform to said order.
Any variation in color from the selection made on the purchase day will be considered conform.
The Products are also covered by the hidden defect warranty provided for by Article 1648 of the French Civil Code [le Code civil]. This warranty must be mentioned by the Client within two years from the discovery of the defect.
Straps in natural leather have a limited lifespan, estimated to be between 6 months and 1 year if worn in normal conditions.
Camille Fournet shall not be responsible for the deterioration of a Product that has been used by the Client in a manner inconsistent with its intended use, or in a manner inconsistent with Camille Fournet’s recommendations.
In order to conserve their quality and appearance, Camille Fournet leather straps:

  • Must never be immersed in water and, more generally, must not be exposed to any liquid.
  • Are not intended to be worn while engaging in manual or sports activities.

Camille Fournet uses leather lining, complying with the Reach regulations and therefore cannot be held responsible for any reactions or allergies.

ARTICLE N°13 – LIABILITY

Camille Fournet is bound by a best efforts obligation with respect to the online selling process; it cannot be held liable for damages resulting from the use of the Internet network, such as lost data, intrusion, the action of viruses, or a service interruption.

Camille Fournet shall not be responsible for the non-performance or improper performance of this online sales contract if this non-performance or improper performance is attributable either to the consumer, or to the unforeseeable, unstoppable act or fault of a third-party, or to a force majeure situation.

ARTICLE N°14 – INTELLECTUAL PROPERTY

All of the components of the Camille Fournet online boutique are and shall remain the exclusive property of Camille Fournet.
It is expressly prohibited to represent, reproduce or reuse, in any form whatsoever, including partially, components of the site, including, but not limited to, software programs, visuals or sound elements.

ARTICLE N°15 – PERSONAL DATA

Camille Fournet collects and processes the personal information provided by the Client, solely for the purposes of completing the Client’s order. Camille Fournet shall be entitled to send the Client e-mails, in order to inform the Client of changes to its catalogue. The Client shall be entitled to request to no longer receive these solicitations, by clicking on the link provided for this purpose.
The processing constituted by the Camille Fournet online boutique has been declared to the “CNIL” [France’s national Data Processing, Files and Individual Freedoms entity] on 11/03/2011, registered under the number 1491110v0.
In accordance with the provisions of French Act 78-17 of 6 January 1978 concerning data processing, files and freedoms, the Client has the right to access and rectify the information processed by Camille Fournet concerning her/him. The request must be made following the communications methods stated, and to the address mentioned, in the “Customer Service” article below.

ARTICLE N°16 – AGREEMENTS OF PROOF

These standard terms, the order form confirmed by the Client, the invoice, and the information recorded at the time of the Client’s placement of the order, shall be kept by Camille Fournet on an electronic medium containing a mechanism ensuring the integrity of said information.
The aforementioned electronic recordings shall be deemed by the parties as proof of the communications, order and online selling contract entered into between the two parties.
The Client agrees to receive the various communications referred to in these standard terms, in particular, concerning the delivery and return of the Products, by e-mail, to her/his address declared at the time of the order.
If the Client chooses to contact Camille Fournet by e-mail, s(he) agrees that the latter will use e-mail to reply to her/his email communication.

ARTICLE N°17 – CUSTOMER SERVICE

ARTICLE N°18 – GOVERNING LAW

The law governing this contract is French law, to the exclusion of the Vienna convention on the international sale of goods.
